Mr. Drawdy assists a broad range of clients with litigation arising under employee benefit plans, including both welfare and retirement plans.  Mr. Drawdy represents employers, fiduciaries, insurers, and third-party administrators in employee benefit plan related litigation in federal and state courts, including fiduciary and benefit claims litigation under ERISA.  Additionally, Mr. Drawdy assists clients with the design and drafting of employee welfare benefit plans, including group health and disability benefit plans.  He also assists clients in complying with HIPAA privacy, security, special enrollment, and nondiscrimination regulations; COBRA continuation coverage requirements; disclosure requirements under ERISA; and benefit claims and appeals processes and procedures. 


Experience

Some of the matters Mr. Drawdy has handled include:

  • Defending employers and plan fiduciaries against ERISA breach of fiduciary duty claims, including claims based upon alleged fiduciary misrepresentations and alleged misappropriation of plan assets
  • Defending plan fiduciaries against claims for benefits brought by plan participants and beneficiaries
  • Defending insurers of benefits in benefit claims brought by plan participants and beneficiaries
  • Defending employers and plan fiduciaries against claims for the alleged failure to comply with the notice and continuation requirements imposed by COBRA
  • Defending plan fiduciaries against claims for the alleged failure to comply with ERISA’s disclosure requirements
  • Defending employers and plan fiduciaries in actions brought by the Department of Labor for the alleged failure to timely file annual reports (Form 5500) for employee benefit plans
  • Defending employers and plan fiduciaries in claims by retirees based upon changes to retiree welfare benefits
  • Advising covered entities on compliance with the HIPAA Privacy and Security Regulations
  • Advising business associates to HIPAA covered entities on their obligations under the HIPAA Privacy and Security Regulations
  • Assisting covered entities with the drafting and implementation of policies and procedures required by the HIPAA Privacy and Security Regulations
  • Advising covered entities and business associates in the face of improper uses or disclosures of protected health information
  • Advising employer of their notice and disclosure obligations under state security breach notification laws
